{0>Article 2<}100{>Artikolu 2 <0}

1. {0>An International Supplementary Fund for compensation for pollution damage, to be named "The International Oil Pollution Compensation Supplementary Fund, 2003" (hereinafter "the Supplementary Fund"), is hereby established.<}0{>Fond Supplimentari Internazzjonali għal kumpens għal ħsara mit-tinġis, imsejjaħ "il-Fond Supplimentari Internazzjonali ta’ l-2003 għal Kumpens għal Ħsara mit-Tinġis biż-Żejt" (hawnhekk iżjed ’il quddiem "il-Fond Supplimentari"), hu hawnhekk stabbilit.<0}

{0>(i) in the territory, including the territorial sea, of a Contracting State, and<}0{>(i) fit-territorju, inkluż l-ibħra territorjali, ta’ Stat Kontraenti, u <0}

{0>SUPPLEMENTARY COMPENSATION<}0{>KUMPENS SUPPLIMENTARI<0}

{0>Article 4<}100{>Artikolu 4 <0}

1. {0>The Supplementary Fund shall pay compensation to any person suffering pollution damage if such person has been unable to obtain full and adequate compensation for an established claim for such damage under the terms of the 1992 Fund Convention, because the total damage exceeds, or there is a risk that it will exceed, the applicable limit of compensation laid down in Article 4(4) of the 1992 Fund Convention in respect of any one incident.<}0{>Il-Fond Supplimentari għandu jħallas kumpens lil kwalunkwe persuna li ssofri ħsara mit-tinġis jekk din il-persuna ma kinitx kapaċi tikseb kumpens sħiħ u adegwat għal pretensjoni stabbilita għal din il-ħsara skond it-termini tal-Konvenzjoni dwar il-Fond ta’ l-1992, minħabba li l-ħsara totali taqbeż, jew hemm riskju li taqbeż, il-limitu applikabbli għal kumpens stabbilit fl-Artikolu 4(4) tal-Konvenzjoni dwar il-Fond ta’ l-1992 fir-rigward ta’ kwalunkwe inċident.<0}

2. {0>(a) The aggregate amount of compensation payable by the Supplementary Fund under this Article shall in respect of any one incident be limited, so that the total sum of that amount together with the amount of compensation actually paid under the 1992 Liability Convention and the 1992 Fund Convention within the scope of application of this Protocol shall not exceed 750 million units of account.<}0{>(a) L-ammont aggregat ta’ kumpens imħallas mill-Fond Supplimentari skond dan l-Artikolu għandu jkun limitat fir-rigward ta’ kwalunkwe inċident, sabiex is-somma totali ta’ dak l-ammont flimkien ma’ l-ammont tal-kumpens attwalment imħallas skond il-Konvenzjoni dwar ir-Responsabbiltà ta’ l-1992 u l-Konvenzjoni dwar il-Fond ta’ l-1992 fl-iskop ta’ l-applikazzjoni ta’ dan il-Protokoll ma taqbiżx il-750 miljun unità ta' kont.<0}

3. {0>Where the amount of established claims against the Supplementary Fund exceeds the aggregate amount of compensation payable under paragraph 2, the amount available shall be distributed in such a manner that the proportion between any established claim and the amount of compensation actually recovered by the claimant under this Protocol shall be the same for all claimants.<}0{>Fejn l-ammont ta’ pretensjonijiet stabbiliti kontra l-Fond Supplimentari jaqbeż l-ammont aggregat ta’ kumpens imħallas skond il-paragrafu 2, l-ammont disponibbli għandu jitqassam b’tali mod li l-proporzjon bejn kwalunkwe pretensjoni stabbilita u l-ammont ta’ kumpens attwalment miġbur mill-pretendent skond dan il-Protokoll ikun l-istess għall-pretendenti kollha.<0}

4. {0>The Supplementary Fund shall pay compensation in respect of established claims as defined in Article 1(8), and only in respect of such claims.<}0{>Il-Fond Supplimentari għandu jħallas kumpens fir-rigward ta’ pretensjonijiet stabbiliti kif imfisser fl-Artikolu 1(8), u biss fir-rigward ta’ dawn il-pretensjonijiet.<0}

{0>The Supplementary Fund shall pay compensation when the Assembly of the 1992 Fund has considered that the total amount of the established claims exceeds, or there is a risk that the total amount of established claims will exceed the aggregate amount of compensation available under Article 4(4) of the 1992 Fund Convention and that as a consequence the Assembly of the 1992 Fund has decided provisionally or finally that payments will only be made for a proportion of any established claim.<}0{>Il-Fond Supplimentari għandu jħallas kumpens meta l-Assemblea tal-Fond ta’ l-1992 tikkunsidra li l-ammont totali tal-pretensjonijiet stabbiliti jaqbeż, jew hemm riskju li jaqbeż, l-ammont aggregat ta’ kumpens disponibbli skond l-Artikolu 4(4) tal-Konvenzjoni dwar il-Fond ta’ l-1992 u li konsegwentament l-Assemblea tal-Fond ta’ l-1992 tiddeċiedi proviżorjament jew definitivament li l-ħlas se jsir biss għal proporzjon ta’ kwalunkwe pretensjoni stabbilita.<0} {0>The Assembly of the Supplementary Fund shall then decide whether and to what extent the Supplementary Fund shall pay the proportion of any established claim not paid under the 1992 Liability Convention and the 1992 Fund Convention.<}0{>L-Assemblea tal-Fond Supplimentari għandha mbagħad tiddeċiedi jekk u f’liema miżura l-Fond Supplimentari għandu jħallas il-proporzjoni ta’ kwalunkwe pretensjoni stabbilita mhux imħallsa skond il-Konvenzjoni dwar ir-Responsabbiltà ta’ l-1992 u l-Konvenzjoni dwar il-Fond ta’ l-1992.<0}

1. {0>The provisions of Article 7(1), (2), (4), (5) and (6) of the 1992 Fund Convention shall apply to actions for compensation brought against the Supplementary Fund in accordance with Article 4(1) of this Protocol.<}0{>Id-disposizzjonijiet ta’ l-Artikolu 7(1), (2), (4), (5) u (6) tal-Konvenzjoni dwar il-Fond ta’ l-1992 għandhom japplikaw għal azzjonijiet għal kumpens maħsuba fil-konfront tal-Fond Supplimentari skond l-Artikolu 4(1) ta’ dan il-Protokoll.<0}

3. {0>Notwithstanding paragraph 1, where an action for compensation for pollution damage against the 1992 Fund has been brought before a court in a Contracting State to the 1992 Fund Convention but not to this Protocol, any related action against the Supplementary Fund shall, at the option of the claimant, be brought either before a court of the State where the Supplementary Fund has its headquarters or before any court of a Contracting State competent under paragraph 1.<}0{>Minkejja paragrafu 1, meta azzjoni għal kumpens għal ħsara mit-tinġis imressqa fil-konfront tal-Fond ta’ l-1992 quddiem qorti fi Stat Kontraenti għall-Konvenzjoni dwar il-Fond ta’ l-1992 imma mhux għal dan il-Protokoll, kwalunkwe azzjoni relatata fil-konfront tal-Fond Supplimentari tista’ tiġi ppreżentata, fuq l-għażla tal-pretendent, jew quddiem qort ta’ Stat fejn il-Fond Supplimentari għandu l-kwartieri ġenerali jew quddiem qorti ta’ Stat Kontraenti kompetenti fis-sens tal-paragrafu 1.<0}

1. {0>Subject to any decision concerning the distribution referred to in Article 4(3) of this Protocol, any judgment given against the Supplementary Fund by a court having jurisdiction in accordance with Article 7 of this Protocol, shall, when it has become enforceable in the State of origin and is in that State no longer subject to ordinary forms of review, be recognised and enforceable in each Contracting State on the same conditions as are prescribed in Article X of the 1992 Liability Convention.<}0{>Bla ħsara għal kwalunkwe deċiżjoni li tikkonċerna d-distribuzzjoni msemmija fl-Artikolu 4(3) ta’ dan il-Protokoll, kwalunkwe sentenza mogħtija fil-konfront tal-Fond Supplimentari minn qorti li għandha ġurisdizzjoni skond l-Artikolu 7 ta’ dan il-Protokoll, hi rikonoxxuta u tkun infurzata f’kull Stat Kontraneti fuq l-istess kondizzjonijiet li huma preskritti fl-Artikolu X tal-Konvenzjoni dwar ir-Responsabbiltà ta’ l-1992, meta s-sentenza tiġi nfurzata fl-Istat ta’ l-oriġini u f’dak l-Istat mhiex aktar suġġetta għal forma ordinarja ta’ reviżjoni.<0}

2. {0>If the application of the provisions in Article 11(2) and (3) would result in the aggregate amount of the contributions payable by contributors in a single Contracting State in respect of a given calendar year exceeding 20 % of the total annual contributions, the contributions payable by all contributors in that State shall be reduced pro rata so that their aggregate contributions equal 20 % of the total annual contributions to the Supplementary Fund in respect of that year.<}0{>Jekk l-applikazzjoni tad-disposizzjonijiet fl-Artikolu 11(2) u (3) tirriżulta fl-ammont aggregat tal-kontribuzzjonijiet imħallsa mill-kontributuri fi Stat Kontraenti wieħed fir-rigward ta’ sena speċifikata jaqbeż l-20 % tal-kontribuzzjonijiet totali annwali, il-kontribuzzjonijiet imħallsa mill-kontributuri kollha f’dak l-Istat għandhom jitnaqqsu pro rata sabiex il-kontribuzzjonijiet aggregati tagħhom ikunu ugwali għal 20 % tal-kontribuzzjonijiet totali annwali għall-Fond Supplimentari fir-rigward ta’ dik is-sena.<0}

3. {0>If the contributions payable by persons in a given Contracting State shall be reduced pursuant to paragraph 2, the contributions payable by persons in all other Contracting States shall be increased pro rata so as to ensure that the total amount of contributions payable by all persons liable to contribute to the Supplementary Fund in respect of the calendar year in question will reach the total amount of contributions decided by the Assembly.<}0{>Jekk il-kontribuzzjonijiet imħallsa minn persuni fi Stat Kontraenti speċifikat jitnaqqsu skond il-paragrafu 2, il-kontribuzzjonijiet imħallsa minn persuni fl-Istati Kontraenti l-oħra kollha għandhom jiżdiedu pro rata sabiex ikun żgurat li l-ammont totali ta’ kontribuzzjonijiet imħallsa mill-persuni kollha responsabbli li jikkontribwixxu għall-Fond Supplimentari fir-rigward tas-sena kalendarja in kwistjoni jilħaq l-ammont totali ta’ kontribuzzjonijiet deċiż mill-Assemblea.<0}

4. {0>The provisions in paragraphs 1 to 3 shall operate until the total quantity of contributing oil received in all Contracting States in a calendar year, including the quantities referred to in Article 14(1), has reached 1000 million tons or until a period of 10 years after the date of entry into force of this Protocol has elapsed, whichever occurs earlier.<}0{>Id-disposizzjonijiet fil-paragrafi 1 sa’ 3 għandhom japplikaw sakemm il-kwantità totali ta’ żejt suġġettat għal kontribut riċevut fl-Istati Kontraenti kollha f’sena kalendarja, inkluż il-kwantitajiet imsemmija fl-Artikolu 14(1), tilħaq l-1000 miljun tunnellata jew sakemm jgħaddi perijodu ta’ 10 snin wara d-data tad-dħul fis-seħħ ta’ dan il-Protokoll, liema minnhom iseħħ l-ewwel.<0}
