Return to Work Protocol

PROCEDURES:

Responding to an incident or injury:
Workers:

  • Report to supervisor or first aid of any incident, or injury.

  • Complete a Worker's Report of Injury (WCB form)and forward this to the Yukon Workers’ Compensation Health and Safety Board (WCB) office.

  • Obtain a job description if available and forward to WCB

  • Have the functional abilities form completed by the attending physician. If there is no form available onsite contact WCB to obtain one.

  • Return the Functional Abilities Form to your supervisor immediately. You will be part of the “Case Management Team”. The team will review the information and arrange return to work based on the information provided by the physician and submit a RTW Plan to the WCB. This plan will be updated until you are back to your regular work duties.

  • The doctor will tell you if you can return to your regular duties and will give you the completed Functional Abilities Form necessary for assessing your physical capabilities if you are to be placed into a Modified Work Program. Give the completed form to the Supervisor. Plan to return to work at the beginning of your next regular shift.

  • If you are cleared to return to Modified Work, you will most likely be assigned to an Interim Work Placement. The initial placement would be modified work, graduated return to work, transitional work, trial of work or training on the job.

Employers:

  • Call 911 for serious injuries

  • Provide first aid if necessary.

  • Transport the worker to the nearest medical facility

  • Report the incident immediately if it is serious. Serious incidents include fatalities, serious injuries, major damage to buildings, and major releases of hazardous substances. If we are unsure whether or not an incident is serious, we will report it anyway

  • Report any injury to WCB within three days. If you find out about the injury more than three days after it occurs report it as soon as possible.

  • Initiate a WCB claim. Submit an employer’s report of injury. Ensure that the completed a workers report of injury.

  • Investigate the incident. Find out what went wrong and what needs to be done to prevent it from happening again. The investigation will include statements from anyone who was present during the incident.

  • Have a package at worksite which includes the workers report of injury, functional abilities form, job descriptions, and modified duties if available

PROCEDURES:

Promoting Return to Work (RTW)
Employers:

If the worker will miss work for an extended period of time, be prepared to do the following:

    • Document who the members of the committee are (labour, management, safety committee members)

    • Create and maintain a separate file for injuries and where this information will be stored

  • Determine who is paying (occupational or non-occupational)

  • Stay in touch with the worker

  • Consider speaking to the nurse advisor at WCB for help

  • Maintain a good working relationship with the person managing the claim at WCB

    • Discuss RTW with the worker and whether modified or alternate duties can be matched to his/her functional abilities

    • Maintain confidentiality

    • Monitor progress with Functional Abilities Forms

If the worker refuses to participate in the modified work program, the Case Management Team will interview the employee and record the reasons for not accepting the offer. This information will be forwarded to WCB.

Follow-up after Return to Work

When the worker reports for modified work, the supervisor and the Case Management Team shall monitor the employee’s progress daily and address any concerns immediately.

When the worker receives written medical clearance to return to regular duties, the case manager will provide a copy of the clearance letter to W.C.B. The Case Management Team and case manager will continue to monitor the employee’s progress to ensure that the return to regular duties is without incident.
Make all reasonable efforts to accommodate all workers injured on the job to return to work in consideration of the functional abilities. The goal is to assist the employee to full rehabilitation
Workers:

  • Stay in touch with employer

  • Be committed to your recovery and RTW

  • Participate in discussions regarding RTW, modified work and or alternate duties

  • Fully participate in your treatment program

The Return-to-Work Plan:

The RTW plan will be developed by the Case Management Team. The RTW Plan will be updated regularly and will include the following information;

  • Specific job duties to be performed

  • Hours of work. These are important in the case of transitional employment where the hours may vary during the placement.

  • Length of placement. This will depend the worker receiving clearance to return to work from the physician.

  • The Return-to-Work Plan will be signed by the injured worker and any other members of the Case Management Team. A copy will be forwarded to WCB.

Options for Return to Work:

The following options for modified work will be considered when returning an injured worker to the work place:

Modified Workmay include hours of work, job duties and work-site modifications that will accommodate an injured worker’s abilities and/or functional limitations.

Graduated Return to Work – is aimed at facilitating an injured worker’s gradual transition from disability to full employment.

Transitional Work – Work not considered part of the employee’s work duties but would benefit the injured worker’s rehabilitation and may include

The injured worker shadowing a person doing his/her pre-accident job.

A meaningful make-work project

  • Taking on the various duties of co-workers that are suitable

  • Trial of Work – is a trial placement of an injured worker with an employer to test and assess an injured worker’s functional capabilities in a new job setting.

  • Training on the Job – is a vocational rehabilitation plan, a contract between the employer, injured worker and the WCB used to identify key elements, milestones, timelines, and the final outcome in advance.
