STATEMENT OF BASIS AND PURPOSE

Summary of the basis and purpose for the rule or rule change. (State what the rule says or does, explain why the rule or rule change is necessary and what the program hopes to accomplish through this rule. How do these rule changes align with the outcomes that we are trying to achieve, such as those measured in C-Stat?)


The purpose of these proposed rules is to align licensing rules with the 2014 Federal Child Care and Development Fund requirements for Federal Fiscal Years 2016 through 2018.
In addition, the proposed rules were drafted in collaboration with child care providers and community stakeholders to address the physical well-being of children in child care and the growing issue of childhood obesity in Colorado, to clarify existing rules, and to provide expanded career pathways for child care personnel.
The Department is statutorily required to review rules on a regular basis and is authorized to promulgate rules for licensed child care programs providing less than twenty-four (24) hour care that create standards and regulations for these child care programs. Each child care program must meet approved minimum standards as established by rule.
An emergency rule-making (which waives the initial Administrative Procedure Act noticing requirements) is necessary:




to comply with state/federal law and/or







to preserve public health, safety and welfare
