State of New York Affidavit in Support

County of Kings of I-485 Application

I, Gulnara ............née ............, being duly sworn, depose and say:
1. I am making this affidavit in support of my application for adjustment of my U.S. immigration status to that of permanent resident alien. Specifically, I am making this affidavit to explain my answer in the affirmative to question 2 in Part 3 of the application form through which I seek this adjustment of my status, namely U.S. Citizenship and Immigration Services (hereinafter, USCIS) Form I-485.

2. In November of 2002 I became pregnant, and in August of 2003 I gave birth to my daughter Anna. Her father is my husband, Dmitriy ............. Attached to this affidavit as Exhibit 1 and made a part hereof is a copy of Anna’s birth certificate.


3. Before I became pregnant, and during my pregnancy, I studied English as a second language, as a student consecutively enrolled in three progressively advanced ESL programs at various N.Y. City schools. In addition, a couple of months after the start of my pregnancy, when my English language skills had become adequate to the task, I commenced studying English-language medical textbooks, in order to pass the U.S. Medical Licensing Examination (USMLE). In my native country of Uzbekistan I had worked as a medical doctor and my goal now was to qualify to work as a physician in the United States. During this period of time, also, my husband had started a business, selling automobiles, but the business was just in its preliminary stages. Between my lack of income as a student, and his need to reinvest into his business most of the income he made, we just did not have enough money to pay out of pocket the medical bills that ordinarily attend pregnancy. To be sure, prior to my pregnancy, during the years that my husband and I had lived together, we had benefited from gifts of money that my parents had generously provided to us; but my parent’s resources were truly limited, and we could not in fairness ask them for additional funds to subsidize my pregnancy. Furthermore, as things turned out, I did not have an ordinary delivery; after Anna’s birth, complications were discovered that required additional treatments beyond our financial means.
4. Accordingly, when I discovered I was pregnant, I applied for, and was accepted by, Medicaid. During the course of my pregnancy, Medicaid paid for monthly exams by a Brooklyn-based gynecologist, Dr. Jason ............, M.D. When I gave birth, at the New York Methodist Hospital in Brooklyn, Medicaid paid the cost of the hospital stay and attendant examinations. Finally, after I gave birth, I resorted to Medicaid assistance to pay for the treatment of post-pregnancy complications. My last use of Medicaid was in April of this year.
5. This year, beginning in May, my husband’s business began to be profitable, and this fortunate development has reached the point where we no longer need Medicaid to help us pay for medical treatment. Accordingly, on August 9, 2004, I visited the Medicaid office in Flushing, N.Y., and cancelled my Medicaid enrollment. The supervisor of that Medicaid office informed me that I should be receiving, in about two weeks, two official documents relating to my participation in Medicaid. One document will confirm the cancellation of my enrollment; the other will provide a detailed history of my Medicaid usage prior to that cancellation. If everything goes as planned, and I receive these documents as promised, I intend to bring them to the adjustment interview, as evidence in support of the statements I am making in this affidavit.
6. For two reasons, I do not believe I will require public assistance in the future. My husband’s business has turned a corner and is now stably profitable. Furthermore, I am in the process of passing the examinations that will enable me to practice medicine in this country and thereby contribute to our family’s income. Attached to this affidavit as Exhibit 2 and made a part hereof is a copy of the results of the USMLE Step 1 examination that I took in July of last year, an examination I passed with a good score. I need to take two additional exams before I am fully qualified to practice medicine here: the USMLE Step 2 exam and the USMLE Clinical Skills Examination (CSE), which I will be taking in September and November of this year, respectively. As I am studying conscientiously for these exams, I feel confident that I will pass them as well.
