Breeding/Show Contract

 Echoing Wind Kennels

"Show dog" Means the dog is sold for breeding and/or showing.

1. 
   All points covered in the MN Pet Lemon Law are a part of this contract. A state may/may not have a pet lemon law. That state’s law is the legally binding law. I stand by the MN Pet Lemon Law whatever state “Echoing Wind’s” Pups are sold in.
   

I have read the MN Pet Lemon Law and understand my rights.

2. 
   The pre-fix Echoing Wind’s- is agreed to be used on the AKC registration name.
   

3. 
   It is agreed that a female or male breeding Siberian husky may be bred or stud upon all tests being completed.
   

4. 
   Tests to be completed on this breeding Siberian Husky and any mating Siberian Husky are a minimum of: CERF (no inherited eye disease found), PennHip/OFA (fair, good, excellent), OFA, or similar registering of Thyroid, Cardiac, and Patella can be done at time of x-rays with forms found on www.OFFA.org website. Fill them out and take them to the vet at that time. Test result copies must be sent to Charity Reger, here after CR.
   

5. 
   If circumstance arise that would prevent the buyer from keeping this dog, the buyer promises not to discard this dog, and to make every effort to place the dog in another suitable home. This dog shall not be turned over to any animal shelter or rescue organization. If the buyer is unable to locate a suitable home for the dog the dog shall be returned to the seller together with it’s signed off AKC registration papers - free of Charge.
   
6. 
   Sale restrictions:
   
   1. 
      It is agreed that no 1^st generation offspring of Echoing Wind’s line will be sold as a breeder to individuals without permission of CR.
      
   2. 
      It is agreed that only___ Olga & Viktoriya Gudima___ can keep1^st generation offspring of Echoing Wind’s lines and use as a breeder without permission from CR .
      
   3. 
      It is agreed that 2^nd generation offspring of Echoing Wind’s Line can be sold as a breeder to a individual without permission from CR
      
   4. 
      It is agreed that no offspring of Echoing Wind’s line will be sold as a breeder to any puppy mill, only breeders working to achieve high quality standards with testing and structure evaluation.
      
   5. 
      Breeder will interview customers that a pet/breeding puppy will be placed in an appropriate home.
      
   6. 
      In the case of a male puppy (unless Neutered) the Seller retains the right to use this male for stud services free of charge. The Seller will notify the buyer in advance if such a service is required and will make all necessary arrangements including payment for pre-breeding screening
      
   7. 
      The buyer shall notify the CR if the dog earns any titles.
      
   8. 
      This dog shall be maintained and kept under the personal control of the Buyer and this dog shall be given adequate housing, food, veterinary care, basic obedience training , and shall in no manner be mistreated or neglected.

Seller Warrants & Agrees:

1. 
   Seller CR is the lawful owner of the dam and has full legal right to sell its offspring.
   
2. 
   If the buyer shows the dog in AKC conformation events and cannot get at points on the dog by the time the dog reaches two years old, then the buyer may return the dog to the breeder with the AKC Registration papers in trade, for a new puppy of equal value and purpose.
   
3. 
   The puppy is in sound body & good health at the time of the sale. The puppy has had its first inoculation for Parvovirus, Distemper, Adenovirus, Parainfluenza. For maximum protection we recommend that this puppy receive another inoculation at 9wks & 12wks of age. Buyer is instructed to consult with their veterinarian for advice regarding inoculations and available options such as Coronavirus and inoculations and additional worming (fecal tests).
   
   1. 
      Seller advises against inoculations for leptospria canicola and leptospira icterohaemorrhagia until after the age of 12wks , due to the side effects which sometimes occur in puppies under 12wks.
      
   2. 
      If buyer intends to obedience train this puppy, where it will be in the company of other dogs, I advise inoculations against Kennel Cough. Again consult with your veterinarian!
      
   3. 
      Seller refers all questions regarding inoculations, worming to qualified veterinarian our recommendations are merely suggestions which should be discussed with your veterinarian.
      
   4. 
      Buyer is to arrange a check up of the puppy with a qualified veterinarian within 48 hours of sale. (Excluding weekends and holidays.) Seller shall be notified immediately in the event that the dog/puppy has a defect. If the puppy is ill (not Poisoned) or defective the buyer is entitled to a full refund of the puppy’s purchase price upon the immediate return of the puppy to the seller, together with the signed off registration papers. Seller‘s warranty is limited to the refund of the puppy’s price upon immediate return of
      

the puppy and only under circumstance described below. Seller does not reimburse for Veterinarian expenses.

4. 
   Echoing Wind Siberian’s dog (herein-after “dog” refers to dogs and bitches ) are guaranteed to be OFA certifiable at two years of age NOT before 2 years of age. The dog must be x-rayed by Thirty (30 Months of age, and the x-ray submitted to the OFA for examination and certification. If the OFA finds that dog to have hip dysplasia, the following requirements must be fulfilled in order to obtain a replacement puppy. It is understood that money is NOT refunded, and that their guarantee is for a replacement puppy only.
   
   1. 
      OFA (Orthopedic Foundation for Animals, University of Missouri, Columbia, MO 65210) shall be the sole judge regarding hip dysplasia.
      
   2. 
      We are to receive a copy of the OFA report
      
   3. 
      If the dog has Hip Dysplasia the dog’s registration papers are to be signed over to me.
      
   4. 
      You may keep the dog if you wish or give it to someone else, but it must be neutered or spayed, and we must have written proof of this from the veterinarian who performs the surgery.
      
   5. 
      All freight charges for the replacement dog are to be paid by the owner of the dog.
      
   6. 
      Replacement pups may be chosen from any breeding, that we have available that is similar in price to what you paid for the dog. If you should want a puppy from a more expensive litter we ask only that you pay the difference.
      
   7. 
      This guarantee applies to the original owner of the dog and no dog will be guaranteed and replaced unless our Kennel name is used in front (Prefix) of the registered name of the dog.
      
5. 
   Echoing Wind Siberian’s dogs are guaranteed to be CERF certifiable. The dog must be examined by a DACVO certified veterinarian, by 12 months of age. A written repost of any heritable eye disease must be submitted to the seller with written proof that the dog has been neutered or spayed, and the dogs AKC Registration papers must be signed over to the seller in order to receive a replacement puppy. All guarantees are exactly under the same terms as the Hip Dysplasia. Eye guarantee does not cover injuries to the eye. Buyer’s remedies are for Hip Dysplasia and Hereditary eye disease only. No other disease or injuries or illness, and are limited to replacement puppy as provided above.

This contract is valid from the date of the puppy leave Echoing Wind’s and throughout the lifetime of the dog, or until the buyer transfers ownership to a 3^rd party.

 This Agreement is made and signed by both parties to insure the well being and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligation under this Agreement
