UNEMPLOYMENT INSURANCE APPEAL BOARD

JUNE 29, 2011

WILMINGTON

MINUTES

The meeting was held at 4425 N. Market St. Wilmington, DE. A quorum of the Board was present for the meeting. Present: Elmer L. Newlin, Chairman of the Board, Vance G. Daniels Sr., Donald Dryden, Taube Carpenter, and Beverly Bell, Board Members. Also present, Katisha D. Fortune, Deputy Attorney General and Counsel to the Board, Susan Purcell, Deputy Attorney General and Counsel to the Board, and Tanishia Stewart, Board Secretary.



THE FOLLOWING CASES WERE HEARD BY THE BOARD:

Stephanie Cockerman v. Bear Eye Center – AD 10765716
The claimant requested a postponement, and the request was approved by the Board Chairman.
Kristan Hughart v. Christiana Care – AD # 20766321
Present: Kristan Hughart, claimant; Carolyn Osborn, employer representative; Nancy Hamilton, employer witness; Michele Eklund, observing. A motion was made by Mr. Daniels, and seconded by Mr. Dryden. The Board moved to affirm the referee and award benefits. All members agreed.
Dedrick Dyton Jr. v. Star Building Service – AD # 10764666
Present: Donnie Skinner, employer representative; William Pearson, employer witness. Although duly notified, the claimant, Dedrick Dyton Jr., failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Carpenter. The Board moved to dismiss. All members agreed.
Karen Jopson v. Advoserv – AD # 20769400
Present: Karen Jopson, claimant; Jennifer Davis-Oliva, employer representative; Katherine O’Brien, employer witness. A motion was made by Mr. Dryden, and seconded by Mr. Daniels. The Board moved to affirm the referee and deny benefits. All members agreed.

Al Butcher v. Target – AD # 10764936
The employer requested a postponement, and the request was approved by the Board Chairman.
Felicia Ritvalsky v. J & J Staffing – AD # 00755171
The claimant requested to withdraw the appeal, the request was approved by the Board Chairman.
Thomas J. Henry v. Diamond State Port – AD # 10768081
Present: Thomas J. Henry, claimant. Although duly notified, the employer, Diamond State Port, failed to appear. A motion was made by Mr. Daniels, and seconded by Mr. Dryden. The Board moved to affirm the referee and deny benefits. All members agreed.
Ceran Taylor v. Hebron Vending – AD # 10765642
Present: Sandy Deaver, employer representative. Although duly notified, the claimant, Ceran Taylor, failed to appear. A motion was made by Mr. Dryden, and seconded Mrs. Carpenter. The Board moved to dismiss. All members agreed.
Stephanie Bray v. Siemens – AD # 20769931
Present: Jeff Martin Esq., claimant’s attorney; Stephanie Bray, claimant; Hazel Bray, observing; Rhonda Vible, HR, employer representative; Wayne Burge, employer witness. A motion was made by Mrs. Bell, and seconded by Mrs. Carpenter. The Board moved to reverse the referee and award benefits. Mr. Dryden and Mr. Newlin agreed. Mr. Daniels was not present for the hearing. Jeff Martin wants to be noticed separately.
J’Mai Brooks v. 3rd Screen Wireless – AD # 20766555
Present: Josh Jiminez, employer representative. Although duly notified, the claimant, J’mai Brooks, failed to appear. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to affirm the referee and award benefits. Mrs. Carpenter and Mr. Newlin agreed. Mr. Daniels was not present for the hearing.
Vaughn Driver v. None Involved – AD # 10766712
Present: Vaughn Driver, claimant; Dwayne Manlove, agency representative. A motion was made by Mrs. Carpenter, and seconded by Mr. Dryden. The Board moved to affirm the referee and deny benefits. Mrs. Bell and Mr. Newlin agreed. Mr. Daniels was not present for the hearing.

Present: Veronica Young, claimant; Dwayne Manlove, agency representative. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to affirm the referee and deny benefits. Mrs. Carpenter and Mr. Newlin agreed. Mr. Daniels was not present for the hearing.

Present: Tina Thomas, claimant. A motion was made by Mr. Dryden, and seconded by Mrs. Bell. The Board moved to affirm the referee and deny benefits. Mrs. Carpenter and Mr. Newlin agreed. Mr. Daniels was not present for the hearing.
