In the Name of the Azerba ani Woman
followings:
5.0.1. formation, improvement and development of the normative legal base for ensuring
gender equality;
5.0.2. conduction of gender expertise of the normative legal acts;
5.0.3. development and materialization of national programs for ensuring gender equality;
5.0.4. propagation of the culture of gender equality.
Article 6. Objectives of the state in ensuring gender equality
The state takes measures for removing all the forms of the gender inequality, for creating equal
opportunities for men and women, for not allowing the representative of one sex have superiority
on the representative of another sex in the administration of the country, in the adoption of
decisions.
Article 7. The objectives of the employers
7.1. The employer ensures the equality of men and women at work.
7.2. The employer has the following objectives:
7.2.1. to treat equally and create equal opportunities for anyone in the employment, in the
promotion at work, in the acquisition of new professions, in the improvement of one’s qualifi cation,
in the appreciation of one’s work and in cases of dismissal, irrespective of the sex;
7.2.2. to create the same work conditions for persons engaged in the same work, irrespective
of their sexes;
7.2.3. not to apply different forms of punishment to persons for the same violation of discipline,
irrespective of their sexes;
7.2.4. to fulfi ll the provisions of Article 9 and Article 10 of This Law;
7.2.5. to take measures for preventing to sexual harassment and discrimination because of
one’s sex:
Article 8. The objectives of the employer in removing gender discrimination
8.1. The employer must substantiate that his decision on employment, promotion at work,
improvement of one’s qualifi cations, requalifi cation, estimation of the quality of one’s work,
dismissal from work does not depend on the sex of the employee if there appears a different
approach in the said.
8.2. The employee has the right to demand from the employer to give him/her a written
explanation on the education, professionalism, experience, professional qualities and other
preferences on the employment of the representative of the opposite sex in the case he/she refused
of employment.
Article 9. Equality in the payment of labour
9.1. The persons working at the place and position with same professional skills and degrees, in
the same work conditions must be paid the same wages, rewards and others for the encouragement
for the work of the same value, irrespective of their sexes.
9.2. When the wages, rewards and others paid for encouragement for the same work of the same

value differ, at the demand of the employee the employer must substantiate that the differences are
not connected with the differences in the sexes of the employees.
Article 10. Announcements with discriminatory contents
10.1. The announcements on employment are not allowed to have different demands for men
and women, preference to the representative of a defi nite sex, questions about the marital state or
private life of the job-seeker.
10.2. It is banned to publish announcements of deceptive content, contradicting the principles
of gender equality.
10.3. It is not allowed to announce vacancies only for the representatives of one sex.
10.4. The publication of announcements mentioned in Article 10.3 of the Present Law are
allowed only in those cases when the sex of the employee is the only decisive condition for
employment because of the nature of the work, or in conformity with the Labour Code of the
Republic of Azerbaijan the use of the labour of woman is banned in such jobs.
Article 11. Inadmissibility of any pressure against the employees subjected to sexual
harassment
The persons who have complained from the employer, or managers for being subjected to sexual
harassment can not be subjected to any pressure on the part of the employer or the manager.
Article 12. Annulment of the labour contract
The labour contract of the person subjected to sexual harassment is annulled since the day
shown in his/her application.
Article 13. Equal opportunities in the execution of education rights
13.1. The state ensures equal opportunities for men and women for enjoying their rights to
education.
13.2. The employer ensures equal opportunities for men and women for getting the fi rst and
additional educations, for enjoying vacation rights connected with the education.
13.3. The state ensures equal opportunities for men and women in the admission to the
educational institutions, in granting scholarships to students, in the selection of curricula and
in the assessment of the knowledge in all the educational institutions irrespective of their being
national, or private.
13.4. Text books must ensure the principle of gender equality.
Article 14. Gender discrimination in the activity of educational institutions
14.0. The following cases can be regarded as cases of gender discrimination in the activity of
the educational institutions.
14.0.1. Application of different requirements to men and women in the admission to educational
institutions, in the development of curricula and in the assessment of their knowledge.
14.0.2. Creation of different opportunities for men and women in the selection of the sphere of
education.
