Justice Breyer invented a diagnostic test, which identifies correlations of biomarkers with disease states. When he invented the test he was working in LabCorp, but after a few months, he left his job at LabCorp. He owns a patent for the diagnostic test. After his leaving the company, LabCorp is still continuing to use the diagnostic test without any payment to the owner of the patent. He wants to file a lawsuit against LabCorp but he does not know how the process is organized.
