Təhsilsiz və təbii ki, elmsiz heç bir dövlətin və xalqın gələcəyi yoxdur. Bunun üçün
sosial-iqtisadi tərəqqi çox vacib amillərdəndir. Hazırda Azərbaycanda həyata keçirilən sosial-
iqtisadi siyasətin inkişafı elm və təhsil ilə sıx bağlıdır. Bu isə öz növbəsində Azərbaycanda
insan və vətəndaş hüquqlarının, gənc alimlərin hüquqlarının qorunmasında vacib meyarlardır.
Gənc alimlərin elmdə fundamental sahələrdə nailiyyətlərə yiyələnməsini stimullaşdırmaq və
Azərbaycanın gənc elmi potensialının sosial problemlərinin tədricən həlli istiqamətində döv-
lətin həyata keçirdiyi siyasət davamlı inkişafın təmin olunmasına böyük zəmin yaratmış olur.
Qeyd etmək lazımdır ki, müasir dünyada baş verən qloballaşma müasir elmə yeni
yanaşma tələb etməkdədir. Bu ilk əvvəl dünyada insan hüquqlarının hazırkı vəziyyətinə
diqqət yetirilməsinin vacibliyini göstərir və insanların təhsil hüququnun daha sivil əsaslarda,
bilavasitə elmdə yeni innovasiyaların əldə edilməsinin zərurətini ortaya qoymuş olur. Demok-
ratik dövlətlərdə ictimai-siyasi şüurun və paralel olaraq elmi inkişafın genişlənməsinə təkan
verən mühüm ideyalardan biri və birincisi insan və vətəndaş hüquqlarına göstərilən yüksək
dəyərin nticəsidir desək yanılmarıq.
Hər kəsin konstitusiya və təhsil haqqında qanunda təsbit olunmuş qaydada öz intel-
lektual imkanlarını genişləndirmək hüquqları var. Bu istiqamətdə dövlət dəstəyi və enerji ka-
pitalının intellektual kapitala çevrilməsi üçün yetişən gənc nəsillərin təhsil və elmə cəlb olun-
ması elmdə tərəqqiyə aparan ciddi məsələdir. AMEA strukturlarında fəaliyyət göstərən Gənc
Alim və Mütəxəssislər Şuralarının fəaliyyətinin stimullaşdırılması və müasir meyarlara uy-
ğunlaşdırılması Azərbaycan elmində nailiyyətlərin genişlənməsinə müsbət töhfə verəcəkdir.
Bu isə öz növbəsində gənc alimlərin hüquqlarının qorunması baxımından dövlətin dəstəyinin
böyük əhəmiyyətə malik olduğunu göstərmiş olur.
Azərbaycanda elmin inkişafı üzrə həyata keçirilən milli strategiya konstitusiya hüqu-
qundan çıxış edərək, elm və təhsil qanununun tədqiqat işlərinin yerinə yetirilməsindəki əhə-
miyyətini, yəni dövlətin bu işdə maraqlı tərəf kimi çıxış etdiyini əsaslandırmaqdadır. Bi isə
Azərbaycanda elmi biliklərə yiyələnmək üçün vətəndaşlara şamil edilən təhsil hüququnun son
illərdə daha da genişləndiyindən xəbər verməkdədir. Nəticə etibarilə dövlətin təhsil və elm
siyasətindən gənclər yüksək səviyyədə yararlanmaqdadır və müşahidə olunan müsbət dəyi-
şikliklər gənc alimlərin hüquqlarının müdafiə olunmasında dövlət təminatının ciddi əhəmiyyət
dsaşıdığını təsdiq etməkdədir.

Nowadays, the need toprotectnational security interestsof each state depends on the
number of importantfactors as well as proper regulation of the migration processes. The
sharpdifference inthe level ofdevelopment insome countries, high-level of wages, liberal
business environment, the availability offree economiczonesand also other factors stimulates
migration. Furthermore, national, racial, regional conflicts, problems caused by natural
disastersand emergency situations are other reasons of mass migration of people from one
country to another. But, massive labour migration can also have negative consequences to the
country of origin. The reason is that, a large number of its population is deprived of the
participation in political life of this country.

Countries of origin, especially developing countries with large number of migrant
workers endeavoring to stimulate the employment opportunities for its people while also
protection of their nationals who migrate abroad.In countries of origin main objectives of the
migration policy are promoting employment, protecting welfare of their nationals in
destination countries, protecting rights of their nationals abroad and regulate the
developmental influence of migration.Some countries are much interestedin migration mainly
in attracting qualified specialists in thecountry. At the same time migration is the top priorities
for the international migration bodies in the avoidingthe negative impact ofmigration, human
trafficking, including preventionof illegal migrationin theworld.
Countries of origin and countries of destination should cooperate interactively to
prevent violations such as human trafficking and xenophobia. This will be effective common
protection mechanisms if states migration governance should discussed not only at a local
level, but also regional and international levels.Protection of migrant workers is an important
issue of migration policy for both country of origin and destination. Firstly it is important for
country of origin to protect migrant worker’s labour and human rights in its country. As a
result, same preparation for working conditions abroad will be better experience in the
destination country.
There are also numerous variables such as economic, social, political and cultural which
affect the demand for migrants in destination countries. International migration flows are
influencing by two factors: supply and demand factors. First factor is migrants’ own decision
to move, but demand factor is characterized by destination country’s demand for migrants.
Regulation of labour migration and protection of the rights of migrants in destination country
are provided by the legislations-(such as labour code, law on the protection of foreigners,
migration code etc.) of that country. Butin order to achieve good migration governance in
country these national legislation norms should be consistence to the international and
regional standards.
Interstate cooperation is important for every country for good migration policy. There
are different branches of interstate cooperation, as regional, bilateral, international. Bilateral
migration agreements regulates two countries’ (both origin and destination) agreed principles
in migration process from leaving the country of origin to entry country of destination.
Countries agreed to provide effective measures to protect rights of migrants.
As a conclusion, it is important to note that both countries of origin and countries of
destination have to try to find out new and much more efficient migration policies in order to
improve the overall wellbeing in our constantly changing world. Countries have to unify their
power in international level in order to cope with irregular migration and try to strengthen
migration policy.

The main direction of the activities of the Commissioner for Human Rights of the
Republic of Azerbaijan under the National Preventive Mechanism is the visit of the detention
places according to the plan or in special cases. Regarding this issue, detention places under
the jurisdiction of the NPM were visited and checked in the period between 2019 and 2013.
