3.27 ENVIRONMENT



Summary

The process of approximation of the national legislation with the acquis continued in the reporting period with the adoption of the Law on Waters by the Parliament of the Republic of Macedonia in July 2008.


Numerous trainings were held for the purpose of strengthening the administrative capacities of the relevant institutions with competencies in the environment sector and the process of implementation of the legislation was carried out on a regular basis with issuing permits and conducting the misdemeanour procedure.
27.1. HORIZONTAL LEGISLATION

The capacities of the Ministry of Environment and Physical Planning (MEPP) were strengthened with 3 new employments (1 in the Sector for European Union, 1 in the Directorate for Environment and 1 in the Sector for Cooperation and Project Coordination), 8 employments on temporary basis, as well as with the following workshops, seminars and trainings:



  • 2 workshops on “Risk Management” on 5 and 16 June, 1 workshop on “Irregularities in IPA Procedure” on 17 June, 1 workshop on “Workload Analysis” on 19 June and 1 workshop on “Contracts Implementation Monitoring” on 23 June, 1 workshop on Manual of Procedures for the IPA Coordinators/SPOs for Implementation of IPA Projects for Component 3 on 30 June 2008, 1workshop on Operational Agreements and Guidelines for Project Implementation, on 23 July 2008, 1 workshop on Manual for IPA Component I on 24 July 2008, 1 workshop on Manual for IPA Component III on 25 July 2008. 1 workshop on Project Identification - Logframe and Budget Planning on 6-7 August 2008, all held in Skopje and organised by MF within the EU funded project "Capacity Building in Support to the Decentralisation of Management of Assistance in Republic of Macedonia";

  • MATRA Training for European Cooperation (MTEC) on IPA/Environment from 1-14 June in Rotterdam, the Netherlands;

  • Result Based Project Planning and Monitoring Seminar on 9 and 10 June in Skopje organised by SIDA;

  • Workshop on “Policy and Strategic Planning Strengthening” held on 21 June in Skopje in organisation of the General Secretariat of the Government of the Republic of Macedonia,

  • Training on E-Government Session, on 30 June organised by the Government of the Republic of Macedonia;

  • Ninth meeting of the Joint Expert Group for Water and Industrial Accidents, 9-10 July 2008, Geneva, Switzerland, organised by UNECE;

  • Workshop on communication in nature protection, 8-10 July 2008, Samokov, Bulgaria;

  • Workshop within the project Technical assistance to the development of operational capacity of the police border service, 21-24 July, Bitola;

  • Training on Operational Agreements and Guidelines for Project Implementation, 23 July 2008, Skopje;

  • Training on Manual for IPA Component I and III, 24-25 July 2008;

  • Public debate upon the EIA Study for Corridor X section Demir Kapija –Smokvica, 25 July 2008, Gevgelija;

  • Round table on the Report “Laws preparation and regulatory management in Republic of Macedonia”, organised by the Ministry of Justice and the General Secretariat within the Government of the Republic of Macedonia with cooperation of the OBSE Mission in Skopje, 10-12 September, Struga,

  • Presentation on Standardisation electronic preparation and publication of legal acts, 9 September 2008, Skopje in organisation of SEP.



For the occasion of 21 June DAY OF THE OHRID LAKE Ministry of environment and physical planning on the 20 June with the motto “I love the lake” organized an action for cleaning of the coast at the locality Peshtani. In this action local inhabitants were included, as well as Environmental associations from this region. MEPP set up the caravan in the village Peshtani where it distributed promo materials to the participants
MEPP provided 750.000,00 denars for rehabilitation of 150 children from Veles and 30 children from Miladinovce of the Skopje area, that have chronic health problems and live in the areas affected by air pollution “Topilnica” and “OKTA”. On August 15 2008 the minister of Environment and spatial planning, Dr .Nexhati Jakupi, paid a visit to the children’s resort on Pelister. This action is organised by the “Society of parents for caring for a healthy offspring” from Veles.
In the period from 20-28 August 2008 in Ohrid training was held for the use of the Green packet in the primary schools for about 300 biology and geography from the primary schools from the Republic of Macedonia.
Final version of the Strategy on Informing and communication in the period 2008-2010 within the process for accession in EU was prepared and delivered to the Secretariat for European affairs for adoption by the Government of the Republic of Macedonia.
In the period from 16-22 September “European week of movement” was marked in Gostivar, Bitola, Skopje and Ohrid. The international theme for this years campaign was “Clean air for all” and a special emphasis was given to the marking of 22 September - Day without cars in Skopje when the first standardised bicycle path, completed in cooperation between MEPP, the City of Skopje, British Embassy and Republican Counsel for Traffic Safety, was put in use.

The Government of the Republic of Macedonia in collaboration with ZELS, the municipalities and the citizens association “Day of the tree” on the 21 September organised a massive action for cleaning the dispersed waste in the whole territory of the Republic of Macedonia. This action was coordinated by the MEPP and the Ministry of Transport and Communications in a collaboration with ZELS and the municipalities. The student unions were included as well as the public municipal enterprise and the business sector. The action was conducted as a positive example of acting and as a support of the new “Law on Public Cleanliness”


The final version of National Strategy for Investment in Environment of the Republic of Macedonia was prepared.
MEPP with consent of the MH, MAFWE, ME has adopted an Order on prohibiting placing on the market plastic bags for goods transport in shops, commercial premises and markets where retail trade is performed in food stuffs and small size products intended for general consumption (“Official Gazette of the republic of Macedonia” No.108/2008. The order will come into force on January 1 2009.
ZELS has started with the realisation of the project for the local authorities for preparation and evaluation of B-integrated environmental permits. The duration of this project is until 31 December 2008. The main goal of the programme is through process of learning through doing to provide training of the local authorities’ civil servant for writing of B - integrated environmental permits in accordance to Law on Environment and B adjustment permits with operational plans. In September four workshops were held.
The Progress monitoring in the field of environment 2007/2008 finished, it included 64 Directives, on which tables of concordance and implementation questionnaires were filled in - as it was done for the first Progress monitoring 2006-2007. In September 2008 the first Draft Progress Monitoring Report was sent to MEPP for comments by the Regional Environmental Centre (REC). The finalisation of the report is expected within the next month.
Within the reporting period the final version of National Set of Environmental Indicators is in inter-sectoral consultation.
Indicators for Environment for the Republic of Macedonia have been adopted by the Government of Republic of Macedonia in September 2008.
The updating and upgrading of the Cadastres of solid and hazardous waste, wastewater and air started in 2008, for which tender dossier was prepared and announced in August 2008. Evaluation of the offers based on the announcement is running in September.
Within the Project “Macedonian National Preparations for EU membership from a member state point of view” study visit took place on 02 -06 September 2008, Stockholm, Sweden. The goal of the study visit was for exchanging opinions and present the Swedish experiences in the part of transposition and implementation of EU legislation for nature protection.
For the purpose of Environment impact assessment (EIA) procedure implementation, in the reporting period three public debates were held for EIA Study for Waste Water Treatment Plan for Prilep and Corridor 10. Reports for acceptance of the two EIA Studies were made by the MEPP. Namely, on the basis of the studies on the project environmental impact assessment, the reports on the acceptance (adequacy) of the studies on the projects environmental impact assessment, the public debate and the opinions obtained, a Decisions to grant consent the application for the both projects implementation were issued and published. With this the procedure for the two EIA studies is completed.

115 opinions and consents were issued for acceptance of environmental protection elaborates. Only in September 2008, 97 opinions and 31 consents were given for projects and activities for which elaborate for protection of environment is obligatory.


On 23 September 2008 one public debate was held for EIA about project for construction installation for processing and extraction of industrial waste in Jegunovce.
In the reporting period to the Misdemeanour Commission in the MEPP 30 requests for conducting a misdemeanour procedure were submitted, out of which for 2 fines were paid, while for the remaining 28 the procedure is still ongoing. . Additionally, in the period August-September 2008 35 (thirty-five) requests for conducting a misdemeanour procedure have had submitted, 2 (two) fees were paid, 5 (five) misdemeanour requests were ceased, 29 (twenty nine) were solved.

The representatives from the State Environmental Inspectorate participated on the Plenary Session of the ECENA Network held on 18-19 September in Istanbul, Turkey.


CIVIL PROTECTION

The Law Amending the Law on Protection and Rescue (“Official Gazette of the Republic of Macedonia” No.86/2008) transposes part of the SEVESO II Directive by which involvement of the Directorate in revision of the rescues plans is regulated, and is harmonised with the provisions of the Law on Crisis Management and the Law on Misdemeanours. The law establishes the legal basis for promoting the efficiency and effectiveness of the national protection and rescue system.
In September 2008, Protection and Rescue Directorate was involved in extinguishing the forest fires. On the territory of the state this summer we had total number of 835 fires, among which 320 were forest fires. The total number of burned area is 7829ha and the damage estimated is 1.300.000 EUR. For the fire fighting operations Protection and Rescue Directorate used its own personal resources (4396 people were engaged), 455 members of the local municipalities fire fighting professional units, 810 soldiers from the Armed Forces of Republic of Macedonia, 2298 people from “Macedonian Forests”, 619 people from other public enterprises and 658 from the local population.
The procedure for public procurement of 3 airplanes for fire fighting, 10 fire fighting vehicles for forest fires and 15 fire fighting vehicles for urban fire fighting has started.
On the 21 August, a campaign for cleaning the bed of the river Vardar from the source to the border with Greece has started. The campaign will be carried out by the Protection and Rescue Directorate until the middle of October.

27.2. AMBIENT AIR QUALITY

Within the Twinning Project "Air Quality Improvement", under Component 1 referring to the air legislation, the following acts have been prepared in their final version and currently are in a consultation procedure:



  • Draft Rulebook on the content and the manner of preparation of the National Plan, programs and action plans for air quality protection.

  • Draft Rulebook on monitoring and reporting on air quality Revision of the Rulebook on criteria, methods and procedures of ambient air quality assessment.

The final version of the Preliminary assessment report of air quality in Republic of Macedonia and the Draft List of zones and agglomerations in accordance with the Preliminary assessment report have been prepared.


Final revision due to the final reports under this project related to its all 5 components is finished.
Regarding the work of the Technical Committees No. 17, 6 standards on air quality are being translated in accordance with the Rulebook on criteria, methods and procedures for assessing the ambient air. quality (“Official Gazette of the Republic of Macedonia” No.82/2006) .That will make 6 standards in total.
CLIMATE AND OZONE LAYER PROTECTION

In the area of climate and ozone layer protection, the final draft of the Second National Communication on Climate Change to the Convention on Climate Change (2005-2008) has been developed. MEPP commenced procedure for strategic environmental assessment according to the Law on Environment. Namely the public debate and consultation upon the Communication will last for 30 days to enable all the stakeholders in the Republic of Macedonia to give their comments upon the document. The public announcement was published on the web site of the MEPP and the Project Implementation Unit of the United Nations Convention on Climate Change located in Skopje (www.unfccc.org.mk), while its preparation was supported by UNDP/GEF.
The following chapters are included: National Circumstances, National Greenhouse Gas Inventory, Vulnerability and Adaptation to Climate Change, Climate Change Mitigation, Other Relevant Information, Annex 1: Relevant policies, Institutional and Legislative Framework  by Sectors Annex 2: References and Information Sources.
Within the reporting period, activities in the framework of bilateral cooperation with the Italian Ministry of Environment, land and sea continued in both legislative and technical aspects. Draft agreements with the potential site-owner on the potential projects for reducing GHG emissions under CDM have been prepared. Feasibility studies and/or project planning document for the projects already agreed and with signed contracts with the ministry under the first call for expression of interest are under preparation.
In the reporting period, the second project planning document for Skopje 30 MW cogeneration plant under CDM was submitted to the MEPP as nominated DNA for its final approval.
Delegation of the Ministry participated on the International Workshop "Water and Climate Change in SEE: Understanding Impacts & Planning for Adaptation". Tirana, Albania, 24-25 June 2008.
Working meetings with the representatives of Norwegian Government, Japanese Government, KfW, ADA, British expert-Director on the Friends of the Earth, regarding different Climate Change initiatives have been organised.
