2015 COMMUNITY GARDEN APPLICATION
Community Garden Renters:

Due to construction at Kereiakes there will be a limited number of gardens this year to rent. The actual number of gardens that will be available is not yet finalized. We will be requiring individuals to provide proof of home residence. This could include a driver’s license, phone bill or a BGMU or WREEC bill. Each home residence address will be limited two gardens. The gardens will go on sale on March 17th, 2015 at 8:30 a.m. first come first serve basis.

I hereby apply to use the city garden plot(s) listed below for the current garden season at Spero Kereiakes Park. I understand that this application is good only for the current season and that I must reapply annually. I understand that misuse of the gardens and disregard for other gardeners will not be tolerated and could result in my being banned from future garden rentals.
TERMS OF AGREEMENT:

The Parks and Recreation Department Shall:

a. Plow, disk and mark off gardens.

b. Weather permitting gardens will be ready by March 31.

c. Mow all gardens that have weed growth of 24 inches or more.

d. Not assume any responsibility for theft or damage from gardens.
The Gardeners Shall:

e. Obey all city, state, and federal laws, statutes, ordinances, and policies.

f. The application of pesticides including insecticides and herbicides is prohibited. As defined by the Kentucky Revised Statutes (KRS) chapter 217B "Pesticide" means: Any substance or mixture of substances intended to (a) prevent, destroy, control, repel, attract, or mitigate any pest; (b) be used as a plant regulator, defoliant, or desiccant; or (c) be used as a spray adjuvant, once they have been mixed with an EPA registered product. g. Produce harvested from the gardens may NOT be sold on city property. Anyone selling on city property without a

permit/license will be subject to fines and/or court costs.

h. Maintain the garden in good condition.

i. Notify Parks & Recreation if he/she decides not to use the garden. No Refunds.

j. Pay rental fee in full for each plot. Limit: 2 gardens per household/address.

● $20 for large plot (30’x60’) ● $15 for small plot (30’x30’)

k. Have everything removed from the gardens by November 7^th. The gardens will be plowed under for the winter.

l. Do not remove and/or move the stakes.

m. Be considerate of your neighbor. 

FAILURE TO ADBIDE BY THE PARK REGULATIONS MAY RESULT IN A BAN FOR FUTURE RENTALS.

Release and Waiver Statement:

The responsible party/renter agrees to waive, release, absolve and indemnify, defend and save the City of Bowling Green and its elected and appointed officials, employees and agents harmless from any and all claims, loss, costs or damage for personal injury or property damage, including Lessor’s attorney’s fees and costs, that may arise out of or resulting from or in connection with the consent to use the designated property for a garden plot or the use of the garden plot by the responsible party/renter or his or her agents or any other person using the garden plot at Kereiakes Park.
