NOTICE OF MOTION
Kindly take note that Application will be made on behalf of the above-named Applicants on the 24th day of May 2018 at 
10h00 or as soon thereafter as Applicants may be heard for an order on the following terms:
1. Condoning and authorizing the late registration of the antenuptial agreement entered into by the Applicants within 3 
months of the granting of this Order by which their future matrimonial property regime will be regulated in accordance with the 
terms and conditions contained int eh said antenuptial contract, which constitutes annexure “W5” to First Applicant’s Founding 
Affidavit.
2. That the Registrar of Deeds, Cape Town is authorized to register said antenuptial contract, annexed as Annexure “W5” 
to the founding affidavit (“the ante-nuptial contract”), subject to any legal requirements that may be applicable to such registration, 
in terms of the Deeds Registries Act 47 of 1937, within three months of the date of this order.
3. Directing that the effect of this Order shall not prejudice the rights of any of the creditors of either of the Applicants whose 
claim(s) arose prior to the registration of the antenuptial contract.
4. Granting Applicants such further and/or alternative relief as the above Honourable Court may deem appropriate.
Kindly Further Notice that the affidavits of Wally Lloyd Van Rooyen and Hester Sophia van Rooyen annexed hereto will be 
used in support thereof.
Kindly Further Notice that if any person and/or institution wish to object to the proposed late-registration of Applicant’s 
antenuptial contract or would like to make representations in respect thereof, they can lodge such objections and/or representations 
in respect thereof at the office of the Registrar of the above Honourable Court at 40 Keerom Street, Cape Town, and serve a 
copy thereof on Applicants’ attorneys of record, or they shall be entitled to appear at the hearing of this matter to raise such 
objections and/or to make such representations.
Kindly Further Take Note that a copy of the application, together with the proposed antenuptial contract which Applicants 
are of intention to register, shall lie for inspection at the office of the Registrar of the above Honourable Court at 40 Keerom 
Street, Cape Town, and at the offices of Applicants’ attorneys of record from 14 March 2018.
